Recently, the last holdout of the major label bastion conferred their catalogue to the open-access digital world. Number two ranked label group, Sony-BMG, began an experiment to open their catalogue up to the widely accepted MP3 file format. This move follows not only the other three majors 2007 conversion to DRM-free MP3s, it comes on the heels of Amazon.com’s announcement to go into the digital download business via open-format MP3 files.

On the surface it would appear Sony-BMG is finally heeding the calls by consumer advocacy groups and overwhelming customer preference already leaning to the file format. However, looks can be highly deceiving, as they tend to be from the Sony-BMG label group.

There are very few things in this world people are willing to pay a premium for when it is available for free. Apart from the bottled water industry that seemingly cornered the market for over-pricing an otherwise free offering with a litany of marketing ploys, there are very few other commodities worth spending discretionary income on. As it stands in the world today, music and most entertainment appear to not fall in the same catagory as the current bottled water fetish, despite a consumption rate that might rival it.

Although the entertainment industry, and most specifically the music industry, has yet to truly leverage the potential of Over-the-Air (OTA) downloads to mobile devices with the North American market, the threat of the concept becoming obsolete before it even gets of the ground is very real.Without finger-pointing back to the music industry’s slow adoption of digital media in the first place and its inherent need to diminish the customer experience with its product in the name of protectionism this could be construed as another example of slow adoption.

However, the fault lies not only with the music industry and its inability to leverage the distribution rights to the works but in the device manufacturers and the mobile information carriers as well.

Traditional media versus new media in a battle royal to the conceivable bitter end: Some traditional media looking to stomp out the inevitable adoption of another consumer resource and some new media striving to stake their claim in the ever evolving landscape of consumer adoption. To this struggle, there is an obvious element of key players confined by the grips of their economic model: Viacom and YouTube. Given the entertainment industry’s overarching view of YouTube being a proponent of potential copyright infringements, this is not a surprise based on past experience with network sharing, however, not all is lost in YouTube (and other social networking sites) propensity to enable the proliferation of peer-to-peer marketing versus right’s holder compensation.
